1. Introduction
Welcome to DamGo.
These Terms and Conditions govern your access to and use of DamGo's website, mobile applications and related services.
DamGo is a technology platform designed to connect customers with approved transport and delivery partners for services including:
- Car and taxi transportation
- Motorbike transportation
- Delivery and dispatch services
- Other mobility services introduced by DamGo
By creating an account, accessing the platform or using a DamGo service, you agree to these Terms and Conditions.
If you do not agree with these Terms, you should not use DamGo.
2. The DamGo Platform
DamGo provides technology that facilitates bookings and interactions between customers and participating transport or delivery partners.
Unless specifically stated otherwise, transportation or delivery services available through the platform may be performed by participating transport partners rather than directly by DamGo.
DamGo may establish:
- Eligibility requirements
- Verification procedures
- Safety standards
- Pricing structures
- Service zones
- Platform fees
- Partner requirements
- Operational rules
These may be updated as the service develops.
3. User Accounts
Some DamGo services require an account.
You agree to provide accurate, current and complete information.
You are responsible for:
- Maintaining control of your account
- Protecting your password and verification codes
- Keeping your phone number and account information current
- Activity performed using your account
You must notify DamGo if you believe your account has been accessed without authorisation.
You may not:
- Create fraudulent accounts
- Impersonate another person
- Use another person's identity documents without permission
- Sell or transfer your account
- Manipulate the platform
- Use DamGo for unlawful purposes
4. Booking a Ride or Delivery
Customers may use DamGo to request services available within supported locations.
A booking request may contain:
- Pickup location
- Destination
- Service type
- Estimated fare
- Assigned partner
- Vehicle information
- Booking status
Submitting a request does not guarantee immediate availability of a transport partner.
Availability may depend on:
- Location
- Time
- Number of active partners
- Vehicle type
- Network conditions
- Weather
- Traffic
- Safety considerations
- Operational circumstances
If a selected service type is unavailable, DamGo may allow the customer to choose another available service.
5. Fares and Pricing
The applicable fare will normally be displayed or communicated before or during the booking process where technically possible.
Prices may vary according to factors including:
- Pickup location
- Destination
- Service category
- Distance
- Defined pricing zone
- Additional services
- Operational costs
- Other clearly communicated charges
DamGo may change its pricing structure from time to time.
Changes will not ordinarily alter a completed transaction retrospectively unless an error, fraud or exceptional circumstance requires correction.
6. Payments
DamGo may support payment methods including Mobile Money and other approved payment channels.
Users are responsible for ensuring that sufficient funds are available when making a payment.
Payment processing may be performed by authorised third-party payment providers.
DamGo personnel should never ask you to disclose:
- Your Mobile Money PIN
- Bank PIN
- Password
- Complete OTP or authentication credential unless an authorised system specifically requires an OTP as part of its normal secure authentication process
Always verify payment requests before approving them.
7. Cancellations
Customers may cancel a booking using the available cancellation function.
DamGo may introduce reasonable cancellation rules or charges where necessary to compensate transport partners for significant time or resources already committed to a booking.
Any applicable cancellation charge should be communicated through the platform.
Repeated deliberate, fraudulent or abusive booking and cancellation behaviour may result in account restrictions.
8. Customer Responsibilities
Customers must:
- Provide accurate pickup information
- Be reasonably available at the agreed pickup point
- Treat transport partners respectfully
- Pay applicable fares and charges
- Follow reasonable safety instructions
- Avoid conduct that endangers the driver, rider, passengers or public
- Avoid damaging a partner's vehicle or property
- Comply with applicable law
Customers must not use DamGo to facilitate:
- Criminal activity
- Fraud
- Harassment
- Violence
- Transport of prohibited or unlawful goods
- Dangerous activity
- Abuse of another person
- Any activity prohibited by Ghanaian law
9. Driver, Rider and Delivery Partner Responsibilities
Transport partners must comply with DamGo's onboarding, verification and operational requirements.
Depending on their service category, partners may be required to maintain valid:
- Identification
- Driving licence
- Vehicle documentation
- Insurance
- Roadworthiness documentation where legally applicable
- Vehicle or motorbike registration
- Safety equipment
Partners must ensure that required documents remain valid.
Transport partners must:
- Operate safely
- Follow applicable road-traffic laws
- Maintain their vehicle in appropriate condition
- Treat customers respectfully
- Avoid discrimination and harassment
- Follow DamGo safety procedures
- Avoid operating while impaired
- Protect customer information
- Avoid fraudulent bookings or transactions
- Report serious incidents to DamGo
DamGo may suspend a partner whose required documentation expires or where there is a credible safety, fraud or compliance concern.
10. Partner Verification
DamGo may verify applicants before approving them to provide services.
Verification may include:
- Identity review
- Document verification
- Vehicle inspection or photographs
- Physical verification
- Location verification
- Test-drive or operational assessment
- Other appropriate safety checks
Approval is not automatic merely because an application has been submitted.
DamGo may reject an application where required information is incomplete, invalid, misleading or inconsistent with platform requirements.
11. Safety
Safety is a shared responsibility.
Customers and partners should immediately contact the appropriate emergency service or authority where there is an immediate threat to life or safety.
DamGo may investigate reported:
- Accidents
- Threats
- Harassment
- Assaults
- Dangerous driving
- Fraud
- Property damage
- Lost property
- Other serious incidents
DamGo may temporarily restrict accounts while a serious report is investigated.
12. Ratings, Reviews and Feedback
DamGo may allow customers and transport partners to provide ratings, reviews, or feedback.
Users must not submit content that is:
- Knowingly false
- Threatening
- Abusive
- Fraudulent
- Discriminatory
- Unlawful
- Intended to maliciously damage another person's reputation
DamGo may review or remove content that violates platform rules or applicable law.
13. Delivery Services
Where delivery services are available, customers are responsible for accurately describing the item being delivered.
Users must not request transportation of prohibited items, including goods whose possession or transportation is illegal.
DamGo or its delivery partners may refuse suspicious, dangerous or prohibited items.
Special conditions may apply to valuable, fragile, perishable or regulated goods.
14. Lost Property
DamGo may assist customers and partners in attempting to recover items left in a vehicle.
However, DamGo cannot guarantee that lost property will be recovered.
Users should contact DamGo support as soon as reasonably possible after discovering a missing item.
15. Service Availability
DamGo does not guarantee uninterrupted or permanent availability.
Services may be affected by:
- Internet outages
- GPS failures
- Maintenance
- Software faults
- Payment-provider outages
- SMS-provider outages
- Maps or third-party service failures
- Weather conditions
- Safety incidents
- Government restrictions
- Circumstances beyond reasonable control
DamGo may temporarily suspend part or all of the service for maintenance, safety or security reasons.
16. Fraud and Platform Abuse
DamGo may investigate activities reasonably suspected to involve:
- Fake bookings
- Payment manipulation
- Identity fraud
- GPS manipulation
- Multiple fraudulent accounts
- Referral abuse
- Account sharing
- False documentation
- Unauthorised access
- Attempts to compromise DamGo systems
Accounts may be restricted or suspended while credible suspected abuse is investigated.
17. Suspension and Termination
DamGo may suspend, restrict or terminate access where reasonably necessary because of:
- Serious or repeated violation of these Terms
- Fraud
- Safety threats
- Invalid documentation
- Illegal activity
- Harassment or abuse
- Security threats
- Non-payment
- Attempts to compromise the platform
Where appropriate and legally required, affected users may be given an opportunity to provide information relating to the matter.
Users may stop using DamGo at any time.
18. Intellectual Property
The DamGo name, logo, software, designs, graphics, application interfaces and original platform content are owned by or licensed to DamGo unless otherwise stated.
Users may not copy, modify, reproduce, distribute or commercially exploit DamGo intellectual property without permission.
19. Privacy
Use of DamGo is also governed by the DamGo Privacy Policy.
By using the service, you acknowledge that personal information will be processed as necessary to provide the platform and related services, subject to applicable law.
20. Third-Party Services
DamGo may rely on third-party providers for functionality including:
- Maps
- Hosting
- Mobile Money payments
- SMS
- OTP verification
- Notifications
- Analytics
- Other infrastructure
Third-party services may be subject to their own terms and policies.
21. Limitation of Liability
To the extent permitted by applicable law, DamGo will not be responsible for losses caused solely by circumstances outside its reasonable control.
Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded under Ghanaian law.
Users remain responsible for their own unlawful, fraudulent, negligent or deliberately harmful conduct.
22. Indemnity
To the extent permitted by law, a user may be responsible for losses, claims or expenses arising directly from that user's unlawful conduct, fraud, deliberate misuse of the platform or material violation of these Terms.
23. Changes to These Terms
DamGo may update these Terms as the platform, services, law or operational requirements change.
Material changes may be communicated through the website, application or other appropriate channels.
Continued use after an updated version takes effect constitutes acceptance to the extent permitted by applicable law.
24. Governing Law
These Terms are governed by the laws of the Republic of Ghana.
Disputes should first be raised with DamGo so that the parties can attempt to resolve the matter in good faith.
Where a dispute cannot be resolved informally, it may be referred to the appropriate court, regulator or dispute-resolution mechanism in Ghana, subject to applicable law.
